Nassau Asset Management Terms (as of 5-5-2013)

Nassau Asset Management is the sole owner of the information collected/displayed on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. Nassau Asset Management collects information from our users at several different points on our website.

Buyer Registration
It is not necessary for a user to register in order to browse our listed equipment. It is, however, recommended so that the Nassau Asset Management can keep users informed our listings. It is also necessary to register to allow on-line bidding of our equipment.

Client Registration
Clients using our web site to post equipment and obtain usage reports, must first complete the required registration which is contingent upon approval by applicable Nassau Asset Management Staff. Clients, like buyers, who register on our site, will be required to furnish contact and demographic information.

Responsibility of Usage
Nassau Asset Management assumes no responsibility for consequences resulting from the use of, or in any respect, for the content of our Web Site information. This includes (but is not limited to) errors, omissions, assumptions, studies or conclusions. We are not responsible for and expressly disclaim all liability for damages of any kind arising out of use, reference to, or reliance on our information. In no event, including, but not limited to, negligence, shall we be liable for any damages from the use or misuse of, or the inability to use, the content on our Web Sites. This holds true even if we have been advised of the possibility of such damages. Use of our Web Sites, services and software is strictly voluntary and may only be used for lawful purposes.

Cookies and IP Addresses
A cookie is a piece of data stored on the user's hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site except for the "remember me" function. We use IP addresses to analyze trends, administer the site, track user's movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. We do collect log files pertaining to domain names, access times, pages visited, and browser type. These files are not linked to personally identifiable information and are only used for the sole purpose of site management.

Security
This website protects our users information. When users submit sensitive information via the website, information is protected both online and off-line. All of our users' information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information. Our employees are kept up-to-date on our security and privacy practices. We have implemented internal policies and guidelines for data security. In addition, the servers that we store personally identifiable information on are kept in a secure hosting environment.

Opt-out
Users who no longer wish to receive our standard emails may opt-out of receiving these communications readily through our site or via an email link.

Disclaimer
Though we make every effort to preserve your privacy we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site.

Nassau's Sales Policy
All sales are on a cash, cashier's check, or wire transfer basis. No sale is final until funds are received by Nassau Asset Management. All offers including offers at the asking price are subject to review and acceptance. All offers should be submitted in writing clearly stating item, amount, and buyer's information.

Offers may be made in three ways:
1. Online - by making an offer online
2. Fax - by faxing your complete offer to 516-625-1981
3. Phone - by contacting a Nassau sales representative

Terms and Conditions of Sale
All equipment is sold "as is, where is", with no warranties implied or given. Nassau Asset Management makes no express warranty of any kind and disclaims all implied warranties, including warranties of merchantability and fitness for a particular purpose. Further, no commitment is made by Nassau Asset Management as to the functionality or condition of any item. The Buyer is responsible for the transportation and loading of the purchased equipment to the Buyer's location.

All purchased equipment must be removed from Nassau Asset Management's facilities or its location within five (5) working days or be subject to storage fees. We accept no responsibility for damage or loss (be it physical, monetary, or intangible in nature) sustained by any of the parties involved either directly or indirectly as a result of the processing of an order. The buyer assumes all responsibility for the purchased equipment to include any damage and/or loss that may occur after the execution of the sale.

Shipping
Purchased items are packaged, loaded, and shipped at Buyer's expense. Details and requirements regarding the shipment of purchased assets will be arranged between the Buyer and Nassau Asset Management.
